Moving in the correct direction !!

Hi guys and girls!!

I am happy to see that this forum has been created. I think it will be extremely helpful and informational.

I feel this forum is exactly what is needed to convey the "How & Whys" of the mining laws that have been set in place long ago to protect future generations [ours & our kids] rights to mine!

I remember when I first started studying law, way back in my high school days.  I didn't much care about the laws, but the drama in the courtrooms was really something.  But those lawyers and judges got to talking way too fast and started using words that could have been from Planet X.

So I thought, if the lawyers and judge were going to talk fast and use words I didn’t know, I’d just tape them with my brand new, super-duper tape recorder.  It worked great for about 5 minutes.  Now I don‘t know to this day if it was the judge or the bailiff that saw me recording the trial, but me and my recorder were quickly removed from the courtroom, my tape recorder was confiscated and I was led back to the judge‘s chambers.

A few minutes later the judge came through the door with a seriously stern look to his eyes.  He sat down behind his massive desk, and at first, said nothing.  I pondered what my fate was, death by gas or hanging… I just wish I knew why I was about to die.

After about 7 weeks (maybe 2 minutes in real time), the Judge sat up and asked, “young man, how dare you bring a recording device into my courtroom”.  Yep, gonna be hanged for sure…

With a very dry mouth I said, “Your honor, I didn’t know that tape recorders were not allowed in courtrooms and I only brought it into your courtroom to tape the trial so that I could study it in more detail later.”  

The judge sat back and pondered for a minute.  He looked at me and said, “Son, you broke legal protocol and privacy laws and I should find you in contempt of court.”  At that moment I was not certain that my underwear was as clean as my Mother insisted they be, in case of an accident.  I was almost certain this situation was an accident.

The best I could come up with at that time was, “Your honor, I’m sorry.”  

The judge shook his head slowly, side to side… not something that gave me any hope of seeing my family and friends ever again.  The judge then said, “Young man, I will give you five minutes to put in writing to this court, a request to tape the trial proceedings or I have no other option than to find you in contempt.”  With that, he pushed a legal pad and a pen across the desk and then he walked out.

After trying to control my out of control thoughts for about 4 minutes, I simple wrote, “As a student that is interested in the study of law and the court system, I respectfully request of the court, the right and privilege to audio tape the trial proceeding for my own personal reference.”  I signed the request as the Judge returned through the door.

The judge smiled and called the bailiff and instructed him to bring the prosecutor and the defense attorneys to the his chambers.  The judge told me to sit at the back of the room and “keep your mouth shut”.  That was not a problem at this point as my throat was slightly drier than death valley in July.  

When everyone was in the room, the Judge picked up my tape recorder and announced that, “that young man back there, brought this device into the courtroom without my permission and I expect without your knowledge”.  Of course they just HAD to turn and look at me like I was the son of Manson.

In the end, the DA, prosecutor and the judge gave me permission to tape the trial on one condition.  That once a week at 5:00pm on Friday afternoon, I had to report to the Judge’s chambers.  The purpose of the condition was for the Judge and I to discuss the case and why he allowed or denied the attorneys “motions”.  He would ask me questions about the law and if I missed the correct answer, well.. I think you know what the punishment was.. I had to find the correct answer.  

I believe it was the 3 or 4th week, now 2 trials later, that that same Judge gave me my first real law book from his shelf.  I can’t tell you how proud I was and by the way, I still have that law book, some 45 years later.

I hope our efforts to inform our fellow miners will be less painful than my first outing, but I can assure of one thing. Once you understand the law, you will never feel more secure.  In a month or two from now, I venture to guess that most of the people on this forum will wonder, "how did I get by without knowing what I know now."

 At this time there seems to be only one forum section, "Introduction/Tutorial Forum" which is a default forum setup for the initial start of any forum such as this, which is there to help setup the forum initially, any other forum sections would have to be created by the Administrator, which isn't that hard to do.

The "icon characters" or emoticons/similes are to the left of the reply box when replying, if you're not seeing them it maybe a setting within your browser.

Who is the Administrator?

It's not very hard to create other forum sections, I would recommend that the 3 main thread/topics be move to a or their own forum section/s, and the threads/topics of interest  be "Pinned" A.K.A "Sticky" so it/they stays to the top of that section and any threads where you don't want any replies be "Locked" so no other posts are made within that thread, the Administrator will still have the ability to post even in the thread/s that are locked.

I'm an Administrator on one forum and a Moderator on numerous other forums, if any help is needed in this area, please don't hesitant to ask.

To change your time zone go to your profile and near the bottom click the drop-down time zone menu and select +/- the amount of hours to make the forum show the correct time for your area.

Once everything pertinent has been moved from the "Introduction/Tutorial Forum" it will be "hidden".

We do need to get more members on this forum, so get the word out, the Teachers don't want to have to back track too much to get new members up to speed, the more members that this forum has when the classes began the better it will be!!!

That being said, I volunteered to help get the forum more organized, so I'm here to learn just like everyone else is!!

not sure where to post this but I think we have some serious threats coming down the pike . . .  1. The Western Sage Grouse habitat restoration initiative being brought into play by the BLM ( under threat of lawsuit) . . . This is to be greatly feared by miners, ranchers, hay farmers, loggers. If the Sage Grouse is so threatened . .  why don't they "clone" about 10,000 of them and put them zoos. These people just can't think outside the box at all . .  I want my money back.   . . .  2. This new Wilderness Lands Grab act coming. Proposed to take ANOTHER 60,000 acres from Oregon along the Rogue River and in some of the most highly mineralized areas in the Pacific Northwest. . . . This is why I am proposing to congress that they quickly install "The Land Mitigation Act of 2012"  . .  this mitigates acre for acre all land withdrawn back into the counties ( I told them they had better act fast on this as 11 western states are ready to succeed from the union over the amount of federal land there is out west.) . . . . . we need to act just as fast on these two issues . . .  but the culprit is always a third party . .  and so same said true for all terrorist acts . .  you don't know who to sue . . the BLM or the stupid dumbass dipshit envirophobes who go about doing more harm than good.

I don't know if it can be done, but if possible i think it would be nice.  on the main page it shows all the different topic headings.....Classroom....Polls...General.....Tid-bits.....etc.
It would be nice to have under each; on that main page  show the sub-topics.  I THINK?  Or maybe the most recent ones being contributed to.  But I am still working out the navigation of this new forum....as I appear to be struggling following each thread.

Hello all, I would like to say that the closest I ever came to wanting to know anything about laws was how not to get cought by the 'law'. Seriously though, I don't understand alot of what I read when they start having a several page document when all they needed to say was 'keep off the grass'. I guess that is why lawyers are paid so well. I will do my utmost to try to understand what is said/written on this site but please bear with me as I'm sure I'll post in the wrong spot, or ask questions that are simple to others. I do humbley appoligize for that. Thank you for your understanding.

davestones; Relax and WELCOME!!  If you take the time to read and take notes of the weekly "Homework" asignments, the "Classroom" will be where we explain the inner workings of the "Homework" assignments.  When the class is dismissed (from the instructional part) the Classroom will remain open for your personal questionsfor however long as you are a member.  The beauty behind this site is that time is of no importance.. everyone can relax and learn at their own pace.

Please take the time to run around the many Tpoics and threads and I think by the end, you'll have a smile on your face.. a forum forminers, run and operated by miners.

I am new to the site and want to thank you for the effort it takes to maintain the site

I have a question that I hope can be answered on this forum

I have a 6in dredge with duel 11hp/350 pumps that are capable of moving 10-15cuyd/hr, I would like to pursue dredging in Idaho but the restrictions are 15hp max, 5in nozzle max and 5cuyd/hr max

Does anyone know if there is a legal way of applying for a non Recreational permit or commercial dredging permit, or am I just SOL and have to get a smaller system
