I agree we are dealing w/ a loaded gun concept w/ regards to a POO but if you read the case there is plenty to understand here such as:
Here I'll be honest I had to look up the 4th and 7th ammendments (ammendments are always mentioned but do we honestly know what they are? at least for me outside of a few, I didn't know)
Link to the 4th ammendmenthttp://en.wikipedia.org...to_the_United_States_Constitution

DE NOVO
Anew. afresh. Considering the matter anew, the same as if it had not been heard before and as if no decision previously had been rendered. Ness v. Commissioner, 954 F.2d 1495, 1497 (9th Cir. 1992). Such review is 'independent.' Premier v. Fuentes, 880 F.2d 1096, 1102 (9th Cir. 1989).
When a judgment upon an issue in part is reversed on error, for some mistake made by the court, in the course of the trial, a venire de novo is awarded in order that the case may again be submitted to the jury.

A real pain in the ________

This is the only sight that it occurrs on !

Sorry.......Think I was rambling, I edited it. The links worked for me, you can copy and paste, I believe that would get you to the link.
