Hi guys and girls!!

I am happy to see that this forum has been created. I think it will be extremely helpful and informational.

I feel this forum is exactly what is needed to convey the "How & Whys" of the mining laws that have been set in place long ago to protect future generations [ours & our kids] rights to mine!

I remember when I first started studying law, way back in my high school days.  I didn't much care about the laws, but the drama in the courtrooms was really something.  But those lawyers and judges got to talking way too fast and started using words that could have been from Planet X.

So I thought, if the lawyers and judge were going to talk fast and use words I didn’t know, I’d just tape them with my brand new, super-duper tape recorder.  It worked great for about 5 minutes.  Now I don‘t know to this day if it was the judge or the bailiff that saw me recording the trial, but me and my recorder were quickly removed from the courtroom, my tape recorder was confiscated and I was led back to the judge‘s chambers.

A few minutes later the judge came through the door with a seriously stern look to his eyes.  He sat down behind his massive desk, and at first, said nothing.  I pondered what my fate was, death by gas or hanging… I just wish I knew why I was about to die.

After about 7 weeks (maybe 2 minutes in real time), the Judge sat up and asked, “young man, how dare you bring a recording device into my courtroom”.  Yep, gonna be hanged for sure…

With a very dry mouth I said, “Your honor, I didn’t know that tape recorders were not allowed in courtrooms and I only brought it into your courtroom to tape the trial so that I could study it in more detail later.”  

The judge sat back and pondered for a minute.  He looked at me and said, “Son, you broke legal protocol and privacy laws and I should find you in contempt of court.”  At that moment I was not certain that my underwear was as clean as my Mother insisted they be, in case of an accident.  I was almost certain this situation was an accident.

The best I could come up with at that time was, “Your honor, I’m sorry.”  

The judge shook his head slowly, side to side… not something that gave me any hope of seeing my family and friends ever again.  The judge then said, “Young man, I will give you five minutes to put in writing to this court, a request to tape the trial proceedings or I have no other option than to find you in contempt.”  With that, he pushed a legal pad and a pen across the desk and then he walked out.

After trying to control my out of control thoughts for about 4 minutes, I simple wrote, “As a student that is interested in the study of law and the court system, I respectfully request of the court, the right and privilege to audio tape the trial proceeding for my own personal reference.”  I signed the request as the Judge returned through the door.

The judge smiled and called the bailiff and instructed him to bring the prosecutor and the defense attorneys to the his chambers.  The judge told me to sit at the back of the room and “keep your mouth shut”.  That was not a problem at this point as my throat was slightly drier than death valley in July.  

When everyone was in the room, the Judge picked up my tape recorder and announced that, “that young man back there, brought this device into the courtroom without my permission and I expect without your knowledge”.  Of course they just HAD to turn and look at me like I was the son of Manson.

In the end, the DA, prosecutor and the judge gave me permission to tape the trial on one condition.  That once a week at 5:00pm on Friday afternoon, I had to report to the Judge’s chambers.  The purpose of the condition was for the Judge and I to discuss the case and why he allowed or denied the attorneys “motions”.  He would ask me questions about the law and if I missed the correct answer, well.. I think you know what the punishment was.. I had to find the correct answer.  

I believe it was the 3 or 4th week, now 2 trials later, that that same Judge gave me my first real law book from his shelf.  I can’t tell you how proud I was and by the way, I still have that law book, some 45 years later.

I hope our efforts to inform our fellow miners will be less painful than my first outing, but I can assure of one thing. Once you understand the law, you will never feel more secure.  In a month or two from now, I venture to guess that most of the people on this forum will wonder, "how did I get by without knowing what I know now."

Ok.....when you leave this thread and go back to the home page it offers you the opportunity to see threads since your last visit.  how do you go to a main page that says "see all threads"?.  And where are my icon characters?

Bejay,

 At this time there seems to be only one forum section, "Introduction/Tutorial Forum" which is a default forum setup for the initial start of any forum such as this, which is there to help setup the forum initially, any other forum sections would have to be created by the Administrator, which isn't that hard to do.

The "icon characters" or emoticons/similes are to the left of the reply box when replying, if you're not seeing them it maybe a setting within your browser.

Who is the Administrator?

It's not very hard to create other forum sections, I would recommend that the 3 main thread/topics be move to a or their own forum section/s, and the threads/topics of interest  be "Pinned" A.K.A "Sticky" so it/they stays to the top of that section and any threads where you don't want any replies be "Locked" so no other posts are made within that thread, the Administrator will still have the ability to post even in the thread/s that are locked.

I'm an Administrator on one forum and a Moderator on numerous other forums, if any help is needed in this area, please don't hesitant to ask.
